MEDFORD, Ore. -- An Oregon man...filed a lawsuit against the [USFS] and a logging company on allegations they failed to cut down a tree before it fell and injured him.

The suit...says Bert Fernandez...was driving through...Rogue River National Forest...when a 32-foot-tree fell on his truck, seriously injuring him.

He contends the Forest Service...marked the tree for removal and...the logging company was supposed to...cut it down before the accident.
